Well, if you are a company doing business in Europe and have registered your trademarks, it will. As you know, the United Kingdom (UK) has decided to leave the European Union. This has implications as regards the protection under your European Union trade mark(s), namely:

  • When the UK exits the European Union, EU trade mark registrations (EUTMs) will no longer apply in the United Kingdom.
  • Arrangements MAY be put in place effectively to validate existing EUTMs in the UK, but it is not known how, when or at what cost the proposed objective will be achieved or how long the procedure will take bearing in mind that there are well over 1 million EUTMs which currently have effect in the UK.

We believe that companies with important trade marks in use in the UK and currently protected by EUTMs should consider having those trademarks separately registered in the UK to avoid all of the uncertainties.
