On August 7, a class of consumer plaintiffs filed a motion for preliminary approval of a
settlement agreement with a weight loss company. The complaint, filed in May, alleged that the
company sent text messages through the use of an automatic
telephone dialing system without permission and in violation of the
TCPA. The proposed national class consists of 628,610 individuals
who received a text message from the company without their express
written consent since May 7, 2014. The proposed settlement would
require the company to pay $3 million.
