On August 30, 2020, the California Legislature passed Assembly Bill 1281, which would extend until January 1, 2022 the exemptions under the California Consumer Privacy Act for certain human resources and business-to-business information. Governor Newsom has until September 30, 2020 to sign or veto AB 1281. If the governor takes no action on the bill by that time, it will become law.

The exemptions are designed to give businesses regulated by the CCPA more time to comply with the law as applied to personal information about their personnel, job applicants and business contacts. We describe the HR exemption here and the B2B exemption here.

AB 1281 will take effect only if California voters do not pass Proposition 24 - which would enact the California Privacy Rights and Enforcement Act of 2020 - in the November 3 general election. If passed, Proposition 24 will extend the HR and B2B exemptions until January 1, 2023.
