On August 14, 2020, the California Office of Administrative Law (OAL) approved the California Attorney General's regulations regarding the California Consumer Privacy Act (CCPA) and filed them with the Secretary of State. The regulations went into effect immediately on that day.

These regulations implement the CCPA and prescribe the duties for businesses who are subject to the CCPA, such as:

  • Details on the privacy notice businesses are required to provide to consumers, including instructions regarding the form of the notices, their design, and manner of presentation. The notices required include a detailed privacy notice, a concise privacy notice at the time of initial collection of personal information, a notice of the consumer's right that their personal information not be sold, and notice regarding incentives and benefits that the business offers in exchange for the consumer's personal information.
  • Rules regarding the contractual provisions required to protect the privacy of information that a business makes available to its service providers who process that information for the business.
  • Detailed instructions on how to handle and respond to consumers' requests to exercise their rights to receive a copy of their personal information, delete it, or instruct the business not to sell the information.
  • Methods for verifying the identity of consumers who seek to exercise their CCPA rights.
