During the Brexit ‘transition period' EU law has continued to apply in the UK. The transition period ends on 31st December and, from 1st January 2021, EU law will no longer apply in the UK. This brings about some important changes for holders of unitary EU intellectual property rights.

Of all the intellectual property rights, European Union Trade marks (EUTMs) and Registered Community Designs (RCDs) (EU unitary rights) are likely to be the most impacted by the UK's departure from the EU. Currently, EUTMs and RCDs provide protection in each member state of the EU, including the UK.

However, from 1 January 2021, EUTMs and RCDs will no longer cover the UK. The good news is that there will be no loss of rights in the UK. Despite this, holders of such rights should prepare now for the end of the transition period, and for the challenges and opportunities of a post-Brexit world.
