Today's press briefing from the Scottish Government saw the announcement of Scotland's testing system and the first measures of the easing of lockdown. While for many it will still be some time before a return to work, employers need to be aware of the implications the new Test and Protect system.

The UK and Scottish Governments are using slightly different methods of monitoring and controlling the spread, however both systems mean that anyone showing symptoms must be tested and those they have been in close contact with must self-isolate for a period of 14 days.

Employers must therefore be prepared to comply with these requirements when staff members become ill and/or receive notification that they have been in contact with an infected person. At this stage the UK Government have said only that  employers are required to pay for this, so what does that mean for you?

As the new system is rolled out and fully implemented, we are expecting further detail and guidance and will continue to update you, however at this point we do know that those employees required to self-isolate under the test and protect guidance will be entitled to Statutory Sick Pay (following an amendment to the 2020 Regulations).

It is not yet clear whether or not employers will be able to claim any SSP paid back, however we will continue to monitor the guidance and detail being issued.
