On April 15, 2024, Plaintiff Ira Schuman filed an amended class action complaint in the Southern District of New York against Visa U.S.A, Inc., InComm Financial Services, Inc., and Pathward, N.A. Schuman's amended complaint adds a cause of action under federal law on behalf of a nationwide class of Visa Vanilla gift card purchasers. Following this amendment, Schuman now seeks to represent all purchasers of Visa Vanilla gift cards in the United States as well as a separate subclass of consumers who purchased Visa Vanilla gift cards in New York. The amended complaint alleges that the defendants violated federal law by failing to properly investigate and resolve complaints from consumers that their Visa Vanilla gift cards were drained of funds. Schuman also alleges that the defendants violated New York law by failing to disclose to consumers that Visa Vanilla gift cards are sold in packaging that permits thieves to easily gain access to the cards before they are purchased to steal the card's account numbers.

Schuman's lawsuit demands that Defendants adopt better practices to keep consumers' funds secure and compensate consumers who have already been harmed for their financial losses.
