Subsequent to the issue of our Alert on the imposition of movement control measures across Malaysia, the Prevention and Control of Infectious Diseases (Measures within Infected Local Areas) (Movement Control) (Amendment) Regulations 2021 ('MCO Amendment Regulations'), the Prevention and Control of Infectious Diseases (Measures within Infected Local Areas) (Conditional Movement Control) (Amendment) Regulations 2021 ('CMCO Amendment Regulations') and the Prevention and Control of Infectious Diseases (Measures within Infected Local Areas) (Recovery Movement Control) (Amendment) Regulations 2021 ('RMCO Amendment Regulations') were gazetted on 15 January 2021 and came into force on 16 January 2021.

The MCO Amendment Regulations

The MCO Amendment Regulations amend the Prevention and Control of Infectious Diseases (Measures within Infected Local Areas) (Movement Control) Regulations 2021 ('MCO Regulations') by extending the imposition of a movement control order to the state of Kelantan (which was previously under a conditional movement control order) and the district of Sibu, Sarawak (which was previously under a recovery movement control order). The movement control order imposed on Kelantan has effect until 26 January 2021 whereas the movement control order imposed on the district of Sibu has effect until 29 January 2021.

The MCO Amendment Regulations also amend the list of 'essential services' under the Schedule to the MCO Regulations by expanding the ambit of three existing 'essential services' and adding two new 'essential services' as follows –

 

  1. Manufacturing and Production
  1. Aerospace equipment has been amended to include component and maintenance, repair and overhaul (MRO);
  2. Automotive equipment has been amended to include vehicles and components; and
  3. Goods for packaging and printing for food and medical industries has been amended to packaging and printing; and
  1. New categories of Services
  1. Automotive (maintenance and repair); and
  2. Judicial and legal services.

The CMCO Amendment Regulations

The CMCO Amendment Regulations amend the Prevention and Control of Infectious Diseases (Measures within Infected Local Areas) (Conditional Movement Control) Regulations 2021 by extending the imposition of a conditional movement control order to the state of Sarawak except the district of Sibu from 18 January 2021 to 31 January 2021.

The RMCO Amendment Regulations

The RMCO Amendment Regulations amend the Prevention and Control of Infectious Diseases (Measures within Infected Local Areas) (Recovery Movement Control) Regulations 2021 by removing the state of Sarawak from the list of states under a recovery movement control order.

Comments

The redesignation of certain states in Malaysia under the movement control measures is largely due to the spike of Covid-19 infection in the respective states. The state of Perlis is now the only state in Malaysia which is under a recovery movement control order. We remain hopeful that these measures will succeed in containing the spread of the Covid-19 virus in Malaysia.
