The Office of Government Procurement has updated its recent guidance to recommend
that Employers on public sector construction projects consider
extending ex gratia payments to 5 April 2021 (or the permitted date
of Site re-opening, whichever is earlier).
Initial guidance - described in our post here - recommended that ex gratia
payments to contractors would not continue beyond early March
2021.
The OGP has also published supporting documents for further
standard form contracts (PW-CF6 and PW-CF7).
This article contains a general summary of developments and
is not a complete or definitive statement of the law. Specific
legal advice should be obtained where appropriate.
