In view of the situation in Tunisia, the Council of the European
Union has issued a regulation on restrictive measures directed
against certain persons, entities and bodies.
The mechanisms are the instruments that have already been applied
in similar regulations on the freezing of funds and economic
resources owned or held by the natural and legal persons, entities
and bodies listed in the Annex to the Regulation.
This is supplemented by the prohibition of directly or indirectly
making funds or economic resources available to the listed natural
and legal persons, entities and bodies (Article 2 (1) and (2) of
the Regulation).
Articles 4 and 5 of the Regulation stipulate approval criteria
pursuant to which, subject to strict conditions, exceptions to the
prohibitions of Article 2 can be permitted.
In practical terms, one must ensure that the new restrictive
measures against natural and legal persons, entities and bodies of
Tunisia are implemented in the existing screening processes.
