The Copyrignt Act sets out specific situations where various acts do not constitute infringement of copyright in entrepreneurial rights. Certain requirements have to be met before such acts do not constitute infringement.

These include acts done for purposes of judicial proceedings.

For audio-visual items, these include fair dealing for the purpose of research or private study, of criticism or review, or of reporting of news.

Other such acts include:

(1)Copying of unpublished sound recordings and cinematograph films in libraries or archives.

(2)Copying of sound recordings and cinematograph films for preservation and other such purposes.

(3)Filming or recording broadcasts or programmes for private and domestic use.

(4)Use of broadcasts for educational purposes.

The Copyrignt Act also sets out situations where a reproduction of a published edition of a work or authors' works does not infringe the copyright subsisting in the said edition. Generally, if the dealing with or the copying of the work or authors' works is not an infringement, a reproduction of the edition of the work or authors' works in the course of such dealing or copying is not an infringement either.

The Copyrignt Act also sets out situations where the copyright in accessories to imported articles are not infringed. Generally, where the article is not an infringing copy, the copyright in an accessory to the article is not infringed by the importation of the article or the use of such an accessory with the article.

This article is intended to provide a general guide to the subject matter and should NOT be treated as legal advice. Specific legal advice should be sought by you about your particular case and special circumstances.
