4 December, 2012, Athens Court of Appeal Decision No. 4062/2011 In a decision handed down on July 26, 2011, the Athens Court of Appeal (ACA) reversed partially a decision of the First Instance Single-Member Court of Athens (FISMCA) and ruled that the plaintiff, a former employee of the defendant, was entitled to payment for overtime work. However, contrary to the FISMCA decision, the ACA reduced the overall sum for overtime owed to the plaintiff in that it excluded the lawful office break enjoyed by the employee from the calculated working hours and thus did not take into account the break time for overtime calculation purposes.
