For the first time a sound trademark was granted its registration in Colombia. The Superintendency of Industry and Commerce, by means of Resolution No. 02975 of 1998, granted the registration to a company working in the cellular business area.

Pursuant to Article 81 of Decision 344 of the Cartagena Agreement Commission, a trademark is any perceptible sign able to distinguish in the market the products or services commercialized by a person from the products or services commercialized by someone else, which are identical or similar. This article makes it possible to protect in Colombia not only visual signs (nominative, figurative, trademarks including designs, etc.), but also sound, olfactory and tactile trademarks.

It is worth mentioning that the Superintendency of Industry and Commerce has confirmed that the telecommunications sector was the most dynamic sector in filing applications for registrations of trademarks and patents in Colombia during the last year.
