On 6 May 2015 the Ministry of Economic Development and Trade of Ukraine adopted the Order No. 451 "On Making Amendments to the List of Products Subject to Mandatory Certification in Ukraine and Abolition of Certain Orders of the State Committee of Ukraine for Standardization, Metrology and Certification" (hereinafter – "Order No. 451"). This Order reduces the list of products subject to mandatory certification in Ukraine, which was adopted by the Order of the State Committee of Ukraine on the issues of technical regulation and consumer policy No. 28 dated 1 February 2015. Thus, from the moment of entry of the Order No. 451 into force in Ukraine certification of the following goods will not be required:
- Detergents;
- Light-sized tractors (from 1 January 2016);
- Welding equipment;
- Bicycles and baby carriages;
- Kitchenware from ferrous and non-ferrous metals, porcelain, faience;
- Road vehicles, their parts and tools (from 1 January 2016);
- Light industry products;
- Mixtures based on dry milk made for infant food or dietary nutrition;
- Preserves for infant food: fruit, berry, vegetable, vegetable-fruit, vegetable-meat, meat and fish;
- Pipes and bulbs (tanks);
- Chemical power supply;
- Piping fittings.
The Order No. 451 also abolishes certain acts on certification procedure, in particular, the Order of the State Committee of Ukraine for Standardization, Metrology and Certification No. 23 dated 17 January 1997 "On Adoption of the Rules of Mandatory Certification of Road Vehicles, Their Parts and Tools" (will become inoperative from 1 January 2016) and the Order of the State Committee of Ukraine for Standardization, Metrology and Certification No. 322 dated 2 June 1997 "On Adoption of the Rules for Mandatory Certification of Food Products".
Alongside with the Order No. 451 the Ministry of Economic Development and Trade of Ukraine adopted the Order No. 452 dated 6 May 2015 "On Making Amendments to the List of Products Subject to Mandatory Certification in Ukraine" (hereinafter – "Order No. 452") which cancels the obligatory certification of fuel. Thus, certification will not be required for automobile benzine and diesel fuel which are subject to the Technical Regulation on the Requirements to Automobile Benzines and Diesel, Vessel, Boiler Fuels (hereinafter – "Technical regulation") adopted by the ruling of the Cabinet of Ministers of Ukraine of 1 August 2013 No. 927, as well biofuel for benzine engines and diesel engines (unless amount of biodiesel exceeds 7 per cent). Mandatory certification will remain for the fuel which is not covered by the Technical regulation, aviation fuel, alternative fuel and biofuel if amount of biodiesel exceeds 7 per cent.
The experts claim that around 90 per cent of fuel in the Ukrainian market will be exempted from mandatory certification. Thus, this initiative will result in reduction of producers' and importers' costs for certification procedures and entail fall of the fuel prices. Besides, mandatory certification of fuel is not required by the Technical regulation which is harmonized with the EU legislation requirements.
Orders No. 451 and 452 have entered into force from 5 June 2015 except from certain aforementioned rules of the Order No. 451 which will become effective from 1 January 2016.
