In the February edition of GC Agenda China, (subscription required), Morrison & Foerster partner Paul McKenzie commented on the National People's Congress Standing Committee's amendments of the Administrative Penalties Law of China.
"The amendments represent a fairly thorough revamping of China's administrative law rules, providing greater clarity on what government agencies have jurisdiction to impose administrative penalties and the scope of administrative penalties that can be imposed, as well as greater transparency and due process in how penalty decisions are made and reviewed. Generally speaking this is all welcome news for companies looking for fairness and predictability," said Paul.
