The renewal of the annual registration is not necessary for those databases which represent low impact.

On September 20, 2012, the Official Gazette published Regulation 4/2012 (the "Regulation") issued by the Argentine Agency of Personal Data Protection (the "Agency"), under Argentine Data Protection Law No. 25,326. The Regulation amended article 7 of Regulation 2/2005 which was published in February 2005, and provided for the implementation of the Argentine Registry of Databases (the "Registry"). For more information about Registry of Databases see Marval News #s 37, 38, 39 and 46.

Article 7, as amended, confirms that the registration with the Registry shall be valid for one year and that the renewal of such registration must be requested within forty-five days prior to its expiration. The novelty is that the renewal of the annual registration shall not be necessary when, as per informed in the registration form, the number of persons in all databases registered does not exceed five thousand and no treatment of sensitive data is carried out, except for administrative purposes or pursuant to a legal duty.

Through this regulation, the Agency has decided to avoid the misuse of administrative resources and to eliminate the requirement of annual registration for those databases which represent low impact or low potential risk to the rights of the persons whose data is stored.
