Earlier this week, it was leaked that the Trump Administration was proposing a new Federal Rule which would bar foreign nationals, who have legally used federal assistance or benefits in the United States, from obtaining lawful permanent resident status.  This proposed new rule would be in line with Trump's current tough stance on immigration enforcement.  However, at this time, this potential new Rule is only a proposal.  Therefore, it is not enforceable and does not have any effect on current pending applications for adjustment of status or not yet filed applications for adjustment of status. Green and Spiegel is strongly opposed to this proposed regulation because of the detrimental effect it would have on legal immigration to the United States. We hope that Congress, if this matter is raised in a bill, choses to support the immigrant community rather than kowtow to an exclusionary executive branch suggestion.

Green and Spiegel is monitoring these developments closely, and will provide an update if any changes are to be made to the regulations that touch on federal assistance.  For now, this proposed change in policy is not enforceable.  If you have any questions or concerns, please do not hesitate to contact us.
