Chicago Partners Jonathan W. Goken and F. Michael (Mickey) Pasqualino recently obtained summary judgment for their client in a head on trucking collision case in Cook County, Illinois before Judge Christopher Lawlor. The plaintiff, a Union Truck driver was a passenger in our client's truck at the time of the incident. We successfully argued that there was no evidence that showed that our client was negligent in causing the accident and all evidence established that the co-defendant caused the accident.

All of the plaintiff's claimed injuries and damages of roughly $100,000 (from a spinal fusion and knee replacement surgery with physical therapy) were pure speculation and he could not meet his burden of proof against our client. We argued that all evidence and testimony showed that the co-defendant driver was at fault for causing the accident and that there was no question of fact left to be decided against our client.
