Two weeks after announcing that most all employment-based immigrant visa categories would be current July 1, 2007, the Department of State announced today that effective Monday, July 2, 2007, all employment-based immigrant visa numbers were unavailable, and further, would not become available until October 1, 2007 (under fiscal year 2008 numbers).

When the Department of State announced in mid-June that all numbers would be available come July 1, there was an immediate response by applicants who had been waiting up to four years for their number to become current so that they could finish processing their permanent residency cases. The action taken today is unprecedented and once again, places these applicants in a state of uncertainty and further delay.

The American Immigration Lawyers Foundation is preparing to litigate and is looking for plaintiffs and class members whose applications were rejected or returned and have the strongest legal claims. If you would like to support this action and be a class member plaintiff, contact AILF or your attorney for further information.
