The Nevada Gaming Commission has recently made a decision to prevent fantasy sports betting websites such as FanDuel and DraftKings from operating within the state until they are properly licensed. The restriction placed on the two fantasy sports giants may have positive effects on New Jersey's efforts to legalize sports betting in hopes of revitalizing the state's struggling gaming industry.
With many professional sports organizations having financial ties to either DraftKings or FanDuel, some believe that they may find it difficult to argue that sports betting should not be legalized. Examples of this include Major League Baseball, the National Football League and team owners Jerry Jones and Robert Kraft all having stakes in DraftKings.
The association between leagues and fantasy sports websites may give attorneys arguing in favor of New Jersey's legalization of sports betting the ability to question how those with stakes in the mentioned companies can "argue that sports betting should remain illegal outside of a small number of venues when they are intertwined."
According to Fox Rothschild's Nicholas Casiello Jr., "If I'm the state of New Jersey, I want the court to know that the leagues and owners are very involved with fantasy sports."
Casiello continues by mentioning that the argument may not be relevant to the legal issues revolving the Professional and Amateur Sports Protection Act , "but I'd want the judges to be scratching their heads."
