In recognition of the challenges currently facing employers due to COVID-19, on May 8 the U.S. Equal Employment Opportunity Commission (EEOC) announced  that it will delay its collection of 2019 EEO-1 Component 1 data until 2021.

The announcement explains that the EEOC expects to begin collecting 2019 EEO-1 Component 1 data along with 2020 EEO-1 Component 1 data in March 2021, pending approval by the Office of Management and Budget (OMB). The EEOC will notify filers of the precise date the surveys will open as soon as it is available. As a reminder, Component 1 data consists of demographic data of employees broken down by gender, race/ethnicity and job category.

For questions or concerns regarding compliance with the EEOC's data reporting requirements, please contact a member of Kramer Levin's Employment Department.
