The updated State Aid section of our Brexit Legal Guide is now available.

This provides a useful overview, amongst other things, as to whether:

  • during the transition period the existing State aid rules will continue to apply to and in the UK;
  • after the expiry of the transition period, the Commission will retain jurisdiction in relation to any State aid matters initiated before the end of the transition period;
  • post-transition the UK will take the opportunity to shape its own State aid regime, away from the existing rules applied across the EU;
  • the proposed new approach would seek "dynamic alignment" with EU State aid legislation or would opt for more permissive regime that follows WTO rules.
