The Regulation on Notifications in the Energy Market ("Regulation") was published in the Official Gazette on 27.05.2014 and numbered 29012 and enters into force six months following its date of publication. The purpose of the Regulation is to regulate procedures and principles with respect to the collection of data required by Energy Market Regulatory Authority ("EMRA") for surveillance, analysis and reporting procedure of market activities. Also "The Instructions for Use on Notifications in the Energy Market" ("Instruction") was published in the Official Gazette on 24.12.2014 and numbered 29215.

Unless otherwise stated, the Notices shall be made with an electronic signature by the authorized person of the notification obligator. The notification obligator is obliged to submit the document which the application petition for use the Notification System and also a written declaration which shows that the authorized person is individually authorized to notice to the EMRA on behalf of the notification obligator.

The Notices is made through the notification forms which determined by the Energy Market Regulatory Board decision and published on the EMRA'a web site.

The notification obligator is obliged to take all the measures to establish appropriate technical infrastructure, to authorize an authorized person who are qualified.

The Instruction includes the rules regarding the notification obligations under the Regulation. The Regulation sets principles and procedures such as making and amending notifications, collecting notice, authorization and confidentially.

According to the Instruction, the obligation of notification covers the period of license is valid and the periods for the real and legal persons which specified in the Instruction unless otherwise stated. If the obligator is not engage in an activity in the notification period, shall not abolish the obligation of notification. In this case the obligator shall make the notification to indicate that there are no activities in that period. In the event of the termination or expiration of the license, the obligator shall make notices regarding the activities which before the cancellation and the obligator shall make the notices in written instead of electronic signature.

The Regulation allows licensees to inform EMRA regarding any information which the licensee is obliged to provide EMRA through the online information system as stated in Instruction.

The notification obligator can make a request for revision regarding the notices by specifying the grounds. In case the revisions accepted by the EMRA, they can make revisions on the notices which they have done before, within the specified time in the Instruction. In this case the most recently notice is considered valid.

On the other hand the Regulation covers general principles of online notifications which will be conducted through online system to be maintained by the Energy Market Regulatory Authority for electricity, natural gas, oil market and LPG markets.
