From 6 July 2009, telecoms businesses must adjust to complex and wide-ranging changes in Polish telecoms law.

The key changes include:

  • a new market analysis procedure, giving the President of the Office of Electronic Communications (UKE) power to define relevant markets instead of relying on markets listed in a national decree
  • more detailed regulations on data retention as a result of the implementation of Directive 2006/24/EC
  • changes to the network access provisions (following an ECJ judgement ruling that if there is no significant market position, the regulator can only decide the terms of co-operation agreements relating to the interconnection of telecoms networks)
  • improvements to current regulations, such as setting out the content of agreements to provide telecoms services.
