Congress Overhauls the Nationís Bankruptcy Laws
After nearly ten years of ups and downs in the legislative pipeline, President Bush on April 20, 2005 (the "Enactment Date") signed into law the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (the "2005 Act"). The 2005 Act is the most extensive revision of the Bankruptcy Code since its enactment in 1978 and surpasses, in both its breadth and substance, the scope of reform sought by Congress the last time it amended the Bankruptcy Code in 1994.
