The Inspection Program published by the Ministry of Labor and Social Security aims to establish the basis for the new labor and employment inspections in order to achieve an impact on employment conditions regarding safety and health, comprehensive protection of their labor and employment rights and the eradication of abusive hiring and employment practices.

It also seeks to monitor and promote compliance with labor and employment regulations through inspection visits to the workplaces.

The strategies contemplated by the Inspection Program are detailed hereunder:

I. Professionalization of federal labor and employment inspectors.

  • Through courses in which technology will be used as a tool.
  • Certification of the personnel in the standards of competence in the matter of safety and health in the workplace.
  • Supervision of the federal labor and employment representations.

II. Upgrade surveillance processes.

  • Focus and maximize the effectiveness of the scheduling of inspection visits.
  • Carry out inspections at a higher quality level.

III. Restructure labor inspections.

  • Improve regulatory instruments.
  • Focused and specialized inspection visits to workplaces with high-risk activities and instability of employment. As well as the surveillance of labor and employment obligations of an economic nature.
  • Updating of computerized systems and new technologies.
  • Verification of compliance with the Mexican Official Standard (NOM-35-STPS-2018 by its acronym in Spanish) regarding psychosocial risk factors at work.

It seeks the incorporation of supervision and follow-up activities to the support and advisory schemes for companies distinguished by the Ministry of Labor and Social Security, in interest of the most vulnerable sector and verification visits to workplaces incorporated into the Youth Building the Future Program.

The Program is applicable during the 2019 fiscal year and it is our consideration that it pursues to target the Ministry of Labor and Social Security's efforts particularly towards the compliance of companies with obligations related to outsourcing schemes and employee's statutory profit sharing. Thus, we consider that the program will be replicated in the following years within the six-year term management period.
