In an unprecedented move, on 9 March 2020, the Government of Italy published a new decree setting out new emergency measures to contain the spread of COVID-19 throughout Italy.
The Decree in a nutshell
The Decree extends the emergency measures on the movement of people, which were adopted on 8 March 2020 with regards to specific areas of Italy, to the entire territory of Italy. The decree will take effect from 10 March 2020 until 3 April 2020, unless otherwise provided.
The Decree applies only to individuals and does not impose an outright ban. The Decree introduces a system restricting the entrance, exit and travel of people within Italy. However, you will be able to travel within and outside Italy provided that you fall under one of the following situations: (a) you have a valid work reason; (b) in situations of necessity; ( c ) for health reasons; and (d) to return to your residence.
The transit and transport of goods and of the entire production chain to and from the indicated areas is excluded from these emergency measures.
How the Decree affects you
If you are involved in the performance of all work-related activities that cannot be carried out remotely and in the transport of goods, you may enter and exit the territory of Italy, move within it, but with the sole purpose of going to your workplace and carrying out your work-related activities.
If you are an employer, you are not required to provide any specific form certifying the performance of the work-related activities in order to allow your employees to travel. Each individual can self-certify the need to travel because of “proven work needs”.
On the other hand, if you, as an employer, do not require the physical presence of an employee at your place of work, you are permitted to implement agile working, even in the absence of specific individual agreements.
The Decree and sports activities
Finally, the Decree suspends events and competitions of any order and discipline, in public or private places. Sports facilities may be used, behind closed doors, only for training sessions of professional and non-professional athletes, recognised as “national interest” by CONI (Italian National Olympic Committee).
