In our legal update titled, "Bill Seeks to Enhance Regulatory Regime Governing the Disposal of Construction Waste on Private Land" dated 15 July 2013, we advised that the Waste Disposal (Amendment) Bill 2013 (Bill) was introduced into the Legislative Council for scrutiny on 26 June 2013. The Bill sought to amend the Waste Disposal Ordinance (Cap. 354) so as to enhance the regulatory regime for the depositing of construction waste on private land to deter fly-tipping of waste on such land.

In accordance with a notice published in the Gazette on 27 December 2013, the Waste Disposal (Amendment) Ordinance (WDAO) has now been enacted. The WDAO will come into operation on a day to be notified by the Secretary for the Environment.
