De Brauw assisted ASR Real Estate Investment Management (ASR
REIM) with the set-up of a closed-end fund for a joint account
named ASR Dutch Prime Retail Fund, as well as the subsequent
transfer of ASR retail real estate to the fund. ASR Dutch Prime
Retail Fund is structured in accordance with INREV guidelines.
De Brauw was involved in the entire process: advising on the
structure, drafting the term sheet, developing the fund agreement,
and conducting the due diligence and transfer of the real estate
portfolio.
Following the set-up, ASR Dutch Prime Retail Fund will provide
national and international institutional investors the possibility
to invest in the ASR retail real estate portfolio. The initial
closing is scheduled for October 2011. De Brauw will also be
involved in the process of admitting institutional investors to the
fund.
