On December 19, 2012, Normative Resolution Nr. 99, from the National Immigration Council, dated December 12, 2012 ("NR 99/12") was published in the Federal Official Gazette, moving into effect as of the date of its publication.

The above mentioned Resolution, which regulates the granting of temporary work permits/visas for foreigners with an employment agreement in Brazil, revoked Normative Resolutions Nr. 80, dated October 16, 2008, and Nr. 96, dated November 23, 2011.

One of the innovations brought in by the NR 99/12 is the possibility of an individual employer being able to apply for such temporary work permits/visas, and that such applications should be informed, as applicable, by the same documents applicable to a Brazilian legal entity.

Pursuant to said NR 99/12, foreigner's dependents who are authorized to work in Brazil may do so, provided they have received an offer of employment and that they individually obtain their temporary visa according to art. 13, item V, of Law Nr. 6.815, dated August 19, 1980, which will be granted within the period of validity of the original foreigner's visa.
