The Fair Work Ombudsman has today issued a media release identifying that it is reviewing the employment arrangements of up to 125 nursing homes and retirement villages in Queensland in response to complaints by employees and other stakeholders.

The Fair Work Ombudsman is responsible for enforcing compliance with the Fair Work Act 2009 (Cth) and has extensive powers to investigate and prosecute breaches of workplace law, including the minimum conditions of employment prescribed by the National Employment Standards and modern awards.

This is a timely reminder for employers in the industry to review their employment practices to ensure compliance with workplace laws, including modern awards and the National Employment Standards. A penalty of up to $33,000 may be imposed for failure to comply with modern awards or the National Employment Standards, in addition to orders for back pay.
