An incomplete or ill-considered estate plan increases the risk of the estate being subject to a dispute after death. This is particularly the case where an estate plan has been made shortly before death.
The last few years have seen disputes involving estates move well past the traditional challenges of seeking a greater share of the estate, with an increasing number of disputes around capacity, informal Wills and even claims relating to broken promises.
Disputes about deceased estates are becoming more frequent and the consequence of these challenges is that the deceased's estate plan is compromised in some way, often after significant costs are incurred.
