At Carroll and O'Dea Lawyers we understand that a relationship breakdown can be an emotional and difficult time. Our team are compassionate and sensitive and will listen, provide you with comprehensive legal advice and ensure you have realistic expectations.

Rather than fostering a combative mentality we start by encouraging you to attempt to reach a resolution without resort to litigation. Many families are blended families and therefore parties will often have to continue to have contact post separation. We understand this and aim to provide practical advice to help you resolve the matter as quickly, fairly and amicably as possible.

Unfortunately, there are times when parties are unable to agree and the matter must go to court. Our experienced team, who are passionate about advocacy, will ensure you understand every step of the process and will continue to provide practical advice throughout to ensure maximum support. At this stage we will be unrelenting in protecting your interests while at the same time providing you with practical and realistic advice.

Our team can assist with all family law related matters from divorce, parenting issues through to complex property settlements involving multiple companies, extensive real-estate portfolios and self managed superfunds.

By drawing on the skill and experience of all our solicitors and resources we are able to provide you with the highest level of service and advice.

Case study:

The majority of matters are able to be resolved without litigation following a short period of negotiation. If this is the case your agreement can be evidenced in a legal document drafted by our experienced team.

Once proceedings are commenced they can still be finalised before a final hearing. In a recent example we settled a matter following a conciliation conference. The matter involved a husband and wife who had a family home, a family business consisting of four companies and a self managed superfund, which owned the business premises. Through extensive negotiation a settlement was reached whereby the property was divided so each party retained an agreed percentage of the property pool. This was achieved without winding up the company.
