Changes in the rules for sponsorship of alcoholic beverages in Ukraine

The recommendations of the National Council of Television and Radio Broadcasting of Ukraine on the sponsorship of alcoholic beverages – together with the use of trademarks of goods and the services and methods under which they are produced – came into force on 1 October 2018. From that day on, all TV and radio companies, as well as manufacturers of alcohol products, should be guided by these recommendations. Experts from Redcliffe Partners' Intellectual Property practice have prepared for your use a detailed infographics, dedicated to the key requirements of these guidelines.

From 1 October 2018 the recommendations of the National Council of Ukraine on Television and Radio Broadcasting regarding the sponsorship of alcohol brands ("Recommendations") came into effect. These should guide all television and radio organisations and companies associated with or manufacturers of alcoholic beverages.

Key recommendations:

  1. the broadcasting organisation should receive documentary evidence of the sponsor's rights to TM (a copy of the certificate); or personally verify the TM for compliance with the requirements of these Recommendations in case of submitting a copy of the application.
  2. before you mention the name and/or TM of the sponsor note its sponsor's Status
  3. when mentioning the sponsor's name and TM, the volume must remain unchanged
