Earlier this week, the U.S., Canada and Mexico reached agreement on a new trilateral trade pact to replace the North American Free Trade Agreement (NAFTA). The agreement will be known as the United States-Mexico-Canada Agreement, or USMCA.  The labor mobility provisions of the USMCA are largely the same as those of NAFTA – meaning that the TN category as it now exists (including all currently recognized TN professions and minimum education requirements) should remain in effect without change after USMCA is implemented.

The leaders of the three countries are expected to sign the agreement within the next two months.  The USMCA must then be ratified by the legislatures of the three countries before it can take effect.  Ratification is expected to take place in early 2019, at which time USMCA will supplant the 25 year-old NAFTA treaty.
