On January 25th, 2017, the Energy Regulatory Commission published in the Federal Official Gazette the Resolution amending Resolution A/023/2015 interpreting the definitions of petrochemicals and refined products, included in article 4, sections XXVIII and XXIX of the Hydrocarbons Law and Resolution RES/717/2015, which determined which refined products and petrochemicals will continue to be regulated by the first-hand sales regime, published on June 9, 2015 and December 16, 2015, respectively (the "Resolution").

This Resolution establishes that despite the fact that propane is considered a petrochemical when used as an industrial raw material, when such product is used as fuel, it will be considered as a perfect substitute for LPG and therefore a refined product.
